“Unacceptable Delivery”: has the meaning outlined in Clause 5.3(c).
1: AUTHENTICITY
1.1 All Goods sold by NCW come authenticity guaranteed. This authenticity guarantee is protected under warranty for our Customers.
1.2 Authentic refers to an undisputed origin of the watch, not a copy or replica. Due to the nature of used timepieces, some commonly replaced parts, such as the strap, bracelet, crystal, spring bars, or screws may be aftermarket and do not affect authenticity.
2: PRODUCT DESCRIPTIONS
Detailed information specific to each watch will be provided within the product description of timepieces. All information will be as accurate and detailed as possible. In the improbable situation that you believe your timepiece does not match its description, please contact us immediately.
3: INSPECTION PERIOD
3.1 Any purchase made from NCW is supplemented by an Inspection Period conferred to the Purchaser in which there is a no questions asked returns policy, conditional on the provisions of Clause 3.2 being complied with.
3.2 For a return to be accepted as valid within the Inspection Period, the watch must be:
(a) returned in a condition which is identical to that which was originally received by the Purchaser.
(b) All contents, associated papers, booklets and tags sold with the watch must be present.
(c) In the sale of an unworn watch (as specified within its sale description) or watch sold with case stickers, the watch must be returned with all stickers remaining attached and unremoved for the return to be accepted as valid within the initial inspection period. NCW retain complete discretion of re-inspecting timepieces for refund eligibility.
(d) The Purchaser must express their return to NCW within a 3-day period from the receipt of delivery.
3.3 The watch will remain the property of the Purchaser until such times as the redelivery and refund has been made to NCW. Upon completion of the refund and transfer of all monies, the watch will then become the property and title of NCW.
3.4 If the watch is purchased following an in-person viewing the Inspection Period will not apply.
3.5 The Purchaser will be responsible for the shipping liability and costs incurred in returning the watch within this Inspection Period (including the handling of customs in applicable). It is recommended you use a tracked service and retain proof of postage. You must ensure that you pack the products appropriately to prevent damage during transit. Insurance for the shipment is the responsibility of the Purchaser.
3.6 If the watch is deemed eligible for refund upon our inspection, the original purchase price, less outward shipping charges, will be refunded to the Purchaser.
3.7 If the watch is purchased following an in-person viewing the Inspection Period will not apply, notwithstanding whether the watch is purchased online or in person.
3.8 In the case of a sale where the Purchaser has requested polishing or customisation of the watch they have purchased, the watch will become non-returnable (non-refundable & inspection period void) due to the watch having changed following polishing or customisation by direction of the purchaser.
3.9 The re-inspection process and refund of a watch being returned is endeavoured to be completed with 14 working days. In the case of a returned item not eligible for refund, the owner of the watch will be liable for return shipping charge and will hold liability of the item.
3.10 If a purchase has been made on another ecommerce platform (any other than www.northcoastwatches.co.uk) their own (ecommerce or other purchasing platform) policy regarding returns and eligibility for such will stand over that purchase and cannot be handled directly by NCW - please see the Terms and Conditions and policies made available on any other ecommerce platform, including our own specific to the given ecommerce platform terms and condition (if applicable) which will govern the transaction made on that given ecommerce platform.
4: WARRANTIES
4.1 The Warranty provided from North Coast Watches (expressed as NCW in the warranty information) extends to cover the authenticity (outlined in Clause 1) and the correct functioning of the timepiece for a period of 3 months (90 days) from the date of purchase. The NCW warranty exclusively applies to the original Purchaser of the watch from NCW and will be invalid to subsequent owners, NCW retains complete discretion over this assessment or reason to believe otherwise.
4.2 NCW Warranty:
(a) The 3 months (90 days from date of purchase) warranty provided by NCW stands to ensure the correct functioning of your timepiece for the warranty period.
(b) The NCW warranty extends to ensure authenticity (as set out in Clause 1) of your timepiece.
(c) Correct functionality is in respect to the running ability of the watch’s movement. While we ensure all timepieces are running well and have service intervention as needed, time keeping accuracy, power reserves and waterproofing are not covered in this warranty.
(d) The NCW Warranty will be void in respect of accidental damage sustained to the timepiece, any customization to the timepiece or in the event of third-party involvement.
(e) The NCW Warranty stands for 3 months from the date of purchase to the original Purchaser. The Warranty does not cover anything further than stated.
(f) A warranty claim will stand to re-establish the running ability of the watch. Warranty claims are endeavoured to be completed as quickly as possible, but we cannot guarantee a timeframe due to servicing and availability of parts.
4.3 All warranty claims must involve the return of the timepiece to NCW who maintain absolute discretion in respect of this returns policy. In respect of the return of faulty timepieces covered by warranty, the watch should be returned at the Purchasers liability and cost.
4.4 In the case that a warranty claim is made, the warranty will not be reinstated.
4.5 In the case of a returned item not eligible for a warranty claim, the owner of the watch will be liable for return shipping charge and liabilities.
4.6 The Purchaser will be responsible for the shipping liability and costs incurred in returning the watch due to warranty intervention (including the handling of customs in applicable). It is recommended you use a tracked service and retain proof of postage. You must ensure that you pack the products appropriately to prevent damage during transit. Insurance for the shipment is the responsibility of the purchaser.
4.7 In the case of a warranty claim being made on a watch purchased on another ecommerce platform (any other than www.northcoastwatches.co.uk) their own policy regarding returns and eligibility for such will stand over that purchase and as such, the warranty term offered in this case is that of the length of the returns policy set by the ecommerce site or platform where the purchase was made – the warranty offered in this circumstance is ‘NCW’ (see below) with altered valid term for claim in line with the returns policy of the given purchasing platform. In the case of the watch having warranty intervention, NCW will take responsibility and cost in the return of the watch to the owner.
4.8 Manufacturer/Service Warranty:
This implies that the watch is either under its original warranty term given at time of its first purchase (New, not from NCW), or the watch has received a further warranty covering the correct functioning of the timepiece following a service. All watches sold with this warranty arrangement come supplied with their warranty paperwork. This warranty lies directly between the Purchaser and the manufacturer/service provider. This warranty will be noted as ‘manufacture’ or ‘service’ under warranty information. In this case, NCW will have no part to play in the warranty of your watch, returning or handling of any claim of your timepiece, regardless of the purchasing platform.
5: SHIPPING
5.1 All timepieces will be shipped from NCW in Northern Ireland to the Purchasers expressed delivery address.
5.2 Due to the high-value nature of the goods sold by NCW, there are obligations placed on the Purchaser in the receival of their package from NCW.
5.3 Delivery:
(a) Full tracking is provided with every shipment sent from NCW. You will be notified of the dispatch and relevant tracking information by NCW.
(b) Goods are packed carefully and shipped within sealed polythene mail bags. Any signs of interference, tampering or damage prior should therefore be highly visible for the Purchaser upon arrival of the package. When the package arrives, the Purchaser must inspect the outer package for any signs of interference, tampering or damage prior to signing.
(c) The package will be deemed to be an Unacceptable Delivery if the mail bag shows any signs of interference, tampering through rips, tears or any other means of gaining access through the polythene material of the mail bag, or damage on the package.
(d) If the package is an Unacceptable Delivery or the Purchaser has any doubts of the package being so, the Purchaser must either refuse the package or photograph and document the package state with the delivery personnel. If any doubt arises during the unpackaging process, documentation of such must be created and the packaging must be retained. If any doubt is present, you as the Purchaser have the right to check the package's contents before signing the delivery note and accepting the Goods.
(e) If the Purchaser signs the delivery without making any reservations outlined in subsections (b) and (c) above with the courier who delivers the Goods, the Purchaser accepts the Goods and waives any claim.
(f) In some cases, you may be required to provide ID at the time of receiving your package from the courier
(g) We use signed and tracked services where you will be required to sign for the Goods. Should your order not arrive by the estimated delivery date, please contact us as soon as possible.
(h) Please ensure you are present for the receival and signing of the goods. When you sign for the Goods, the Goods are deemed delivered, received and accepted to you the Purchaser. If you are not present and the goods have been signed or marked delivered, NCW cannot accept and responsibility or liability (see Clause 6). If you have instructed a person of trust to receive the Goods on your behalf, it is your responsibility to ensure that they are aware of the conditions for Delivery expressed here.
(i) It is your responsibility to provide us with full and correct delivery address details. If the Goods are returned to us due to incorrect or incomplete details, the full shipment cost will apply for the resending of the goods.
(j) Shipping charges are not included in the price of the Goods on our Website unless stated at the time of purchase.
(k) You may be contacted by our external insurer with further information and instructions surrounding your shipment to ensure claim eligibility in the event of tampering, interference or damages.
5.4 If you do not collect the Goods or rearrange delivery within the time frame set out by the courier, the Goods may be returned to us. We will contact you to receive instruction of how you would like to proceed, however if we do not have correspondence within reasonable time, you will be refunded the purchase price of the Goods themselves, but not the cost of delivery.
5.5 Delivery is complete and deemed to have taken place when the shipment has been signed for via the courier tracking system.
5.6 The responsibility and liability for the Goods remains with NCW until delivery is complete (as outlined in Clause 5.3), where upon delivery the responsibility and liability transfers to you the Purchaser with immediate effect.
5.7 NCW aim to dispatch purchases the same day if possible, however this may take up to 2-3 working days in some cases.
6: TITLE AND LIABILITY
6.1 Title in the Goods shall remain in NCW until the delivery of the Goods has been accepted by the Purchaser.
6.2 Title of the Goods shall transfer to the Purchaser upon accepting delivery of the Goods.
6.3 The party with Title of the Goods will be the party baring Liability for such Goods.
6.4 When the Goods have been delivered to the Purchaser, the Title and Liability for the Goods will remain with the Purchaser in the event of the need to return the Goods to NCW, or an unsuccessful return under Clause 3.
